How Solicitors Use Credibility Assessment

A polygraph examination does not replace conventional legal investigation. It provides an additional, independent source of structured information which may assist solicitors in evaluating the evidence available to them.

Evaluating Client Accounts

Where a client maintains a specific account which is contested or uncorroborated, a credibility assessment may assist the solicitor in evaluating the strength of that account before proceeding.

Resolving Conflicting Accounts

When two or more parties provide contradictory versions of events, an independent credibility evaluation may provide additional structured information to assist the solicitor's assessment.

Supporting Negotiation

In some cases, the results of a credibility assessment may support negotiation or settlement discussions, providing an objective reference point for the parties involved.

Risk Assessment and Due Diligence

Corporate legal teams and litigation solicitors may instruct examinations as part of a wider risk assessment or due diligence process where the integrity of specific information is in question.

Historical Allegations

Where allegations relate to historical events and contemporaneous evidence is limited, a credibility assessment may provide additional investigative information to assist case preparation.

Disclosure Verification

Where the completeness or accuracy of a disclosure is in dispute — whether financial, factual, or relating to specific events — an independent assessment may assist the solicitor in evaluating the information provided.

Instruction Process for Legal Professionals

Every instruction follows a consistent, documented process designed to produce structured investigative information for the instructing solicitor or barrister. No commitment is required at any stage prior to confirmation.

STAGE 1

Confidential Consultation

An initial discussion with the instructing solicitor or barrister to understand the nature of the matter, the specific issues in dispute, and the objectives of the instruction. This may be conducted by telephone or in writing. No commitment is required at this stage.

STAGE 2

Case Review and Suitability Assessment

A review of available documentation and background information, followed by a formal suitability assessment. This determines whether the matter and the proposed examinee are appropriate for examination, taking into account the issue, medical considerations, and overall context.

STAGE 3

Examination Design

Clear, unambiguous questions are formulated based on the specific issues. Questions are developed in consultation with the instructing party and reviewed for methodological suitability. No surprise questions are used at any stage.

STAGE 4

Pre-Test Interview and Examination

A comprehensive interview with the examinee, followed by the examination itself using validated psychophysiological procedures. Non-invasive sensors record physiological data whilst the agreed questions are administered in a controlled environment.

STAGE 5

Analysis and Reporting

Physiological data is analysed using established forensic scoring methodologies. A structured, confidential written report is produced documenting the methodology, questions, analysis, and professional opinion. Reports are provided directly to the instructing solicitor or barrister.

Professional Standards

Examinations conducted to American Polygraph Association and ASTM International standards.
Full documentation at every stage for the instructing party's records.
Quality control review available to ensure objectivity and professional rigour.
Complete transparency regarding the process, its limitations, and appropriate use.
