When the Dispute Turns on a Specific Fact
In many disciplinary, regulatory, or arbitration matters arising from sports law investigations, the critical issue is not the ultimate allegation but a narrowly defined historical fact. A specific-issue polygraph examination can be constructed around that particular factual proposition rather than attempting to address the wider legal question.
Factual propositions suitable for psychophysiological assessment in this context include:
- Whether an athlete was given a particular warning or instruction during a testing or notification procedure
- Whether a specific conversation or meeting occurred, and what was communicated
- Whether confidential information was knowingly disclosed
- Whether an athlete knowingly facilitated prohibited betting or match manipulation
- Whether a particular act attributed to the athlete actually occurred
The relevant issues are defined following review of the pleadings, disciplinary allegations, witness statements, contemporaneous communications, and other material evidence. This is a forensic exercise in issue-definition, not a general credibility sweep.
What polygraph does not determine
A polygraph examination addresses clearly defined factual propositions capable of being tested psychophysiologically. It does not determine whether conduct amounts to a regulatory breach, whether a legally sufficient justification exists, whether a tribunal should accept a particular defence, or any other legal conclusion. Not every credibility dispute will be suitable for psychophysiological assessment; suitability is assessed on a case-by-case basis following confidential review.
